RELEASE OF LIABILITY AND ASSUMPTION OF RISK

The individual (referred to as "I" or "me") desires to participate in the Journey Immersion with Zach Bush provided by M Clinic, LLC, dba Journey of Intrinsic Health (JOIH), a Virginia limited liability company.  

In consideration of the intangible value I will gain by participating in the Event and in recognition of JOIH’s reliance hereon, I agree to all the terms and conditions set forth in this release (the "Release").

I acknowledge, understand and agree that:

• The Event may include, and that I may participate in, certain activities (the “Activities”), which could involve the risk of personal or psychological injury, pain, suffering, temporary or permanent disability, death, damage to property, or financial loss (“Injuries”) whether participating as an attendee or participant at the Event or in any Activity, as a guest at the Location or in activities that the Location offers, or in any other Activity to which I may have access while at the Event. I understand and agree that any Injury I sustain may result from or be compounded by the actions, omissions or negligence of JOIH including the Releasees.    

• The Event or Activities may include other risks including but not limited to physical exertion, potential exposure to allergens (including but not limited to dietary or environmental), and other health related risks as well as other physical activities, dietary changes, and other wellness practices that may not be suitable for everyone. 

• It is my sole responsibility to determine whether I am physically, mentally, and emotionally able to participate in the Event; and, it is solely my responsibility to consult with a healthcare provider to determine whether I can safely participate in the Event or any Activities.  

• I will follow the instructions and guidelines provided by JOIH and the Event contributors and facilitators and to immediately inform them of any health concerns or issues that arise during the Event.

• All information provided during the Event, whether by JOIH, any Releasee or other contributor, including but not limited to workshops, seminars, and written materials, as well as any products or services (“Offerings”), are offered for educational purposes only. Neither the Event nor the Offerings are intended to diagnose, treat, cure, or prevent any medical condition. 

• The Event facilitators and contributors are not licensed medical professionals and that any health-related information provided is not a substitute for professional medical advice, diagnosis, or treatment. 

• I may be photographed and/or videotaped during the Event for internal and/or promotional use. I hereby grant and convey to JOIH all right, title, and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consent to JOIH’s use of my name, image, likeness, and voice in perpetuity, in any medium or format, for any publicity without further compensation or permission.

For purposes of this Release, Activities include but are not limited to:

• walking/hiking in natural environments

• swimming in wild water

• meditation / guided visualization

• breathwork

• movement practices (yoga, qi gong, spinning, etc)

• energy work sessions which may include physical touch (optional)

NOTWITHSTANDING SUCH RISKS, I ACKNOWLEDGE THAT I AM KNOWINGLY AND VOLUNTARILY PARTICIPATING IN THE EVENT WITH AN EXPRESS UNDERSTANDING OF THE RISKS INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM MY PARTICIPATION IN, ATTENDANCE AT OR ACCESS TO THE ACTIVITIES, EVENT OR LOCATION, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF JOIH OR OTHERWISE.

I hereby expressly waive and release any and all claims, now known or hereafter known, against JOIH, and its officers, directors, manager(s), employees, agents, affiliates, shareholders/members, licensors, successors, and assigns (collectively, "Releasees"), arising out of or attributable to my participation in the Event, whether arising out of the ordinary negligence of JOIH or any Releasees or otherwise.  I covenant not to make or bring any such claim against JOIH or any other Releasee, and forever release and discharge JOIH and all other Releasees from liability under such claims. This waiver and release does not extend to claims that Virginia law does not permit to be released by agreement. 

I shall defend, indemnify, and hold harmless JOIH and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers,  arising out or resulting from any claim of a third party related to the Event or my participation in the Event or any Activities, including any claim related to my own negligence or the ordinary negligence of JOIH or the Releasees. 

I hereby consent to receive medical treatment deemed necessary if I am injured or require medical attention during my participation in the Event and authorize the Releasees to obtain any necessary medical treatment for me during the Event. I understand and agree that I am solely responsible for all costs and expenses related to such medical treatment and any related medical transportation and/or evacuation. I hereby release, forever discharge, and hold harmless JOIH and the Releasees from any claim based on such treatment or other medical services. 

JOIH and the Releasees shall not be liable for any failure or delay in performing their obligations or be deemed to have defaulted under or breached this Release, for any failure or delay in fulfilling or performing any term of this Release, when and to the extent such failure or delay is caused by or results from acts beyond JOIH’s control, including, without limitation, the following force majeure events ("Force Majeure Event(s)"): (a) acts of God; (b) flood, fire, earthquake, epidemics, pandemics, or explosion; (c) war, invasion, hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest; (d) government order, law, or actions; (e) embargoes or blockades in effect on or after the date of this Agreement; (f) national or regional emergency; (g) strikes, labor stoppages or slowdowns, or other industrial disturbances; (h) telecommunication or transportation breakdowns, power outages or shortages, inadequate transportation services, or inability or delay in obtaining supplies; and (i) other events beyond the control of JOIH.   Further, I understand that all Event fees are prepaid and non-refundable. In the case of any Force Majeure events, I will receive a credit for $2,997 (the program fee, less 3% card processing fees) towards any existing or future offering by JOIH.

This Release and any additional participant terms and conditions to which I will be subject during the Event, constitutes the sole and entire agreement of JOIH and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of JOIH and me and our respective heirs, successors, and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the Commonwealth of Virginia without giving effect to any choice or conflict of law provision or rule (whether of Virginia or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Charlottesville, Virginia Albemarle County, and I hereby consent to the exclusive jurisdiction of such courts.  

REFUND POLICY

If you absolutely have to cancel your plans, refunds will be issued according to the following schedule:

• More than 3 months in advance: 90% refund

• 1-3 months in advance: 60% refund

• 2-4 weeks in advance: 30% refund

• less than 2 weeks in advance: 10% refund

In the unlikely event that the Immersion is cancelled due to weather or any other unforeseen “Act of God,” your registration fee will be applied to the rescheduled event, or to any other offering from The Journey of Intrinsic Health.
